Terms
Photography and Videography Terms of Service
We love our customers and want to do an excellent job for you. Please read this document thoroughly. This is an agreement between you ("Client") and Realiant Photography ("Photographer") that explains what you should expect from us, as well as what we expect from you. If you have any comments or concerns, let us know right away.
Our goal is to have you as a repeat customer and a happy customer. We do this by providing excellent products and helping make your listing owner happy. If you get referrals from satisfied clients because of the photography, we hope you return the favor and use us again.
Cancellation Fees
Cancelled/Rescheduled Less Than 24 Hours: We charge $75 for shoots cancelled or rescheduled less than 24 hours before the shoot time.
Cancellations Due to No Shows / No Access: If the photographer is unable to gain access to a property more than 20 minutes past an appointment start time due to the Client or the Client's representative arriving late or not providing proper access instructions, it will be considered a cancellation. It will be billed at the full rate of the shoot at Realiant Photography's discretion.
Cancellations Due to Weather: Weather happens. If we see poor weather on the day of your shoot, we will reach out and try to reschedule at no charge. However, if we recommend another day and you still have us come on the original date, and the weather will not cooperate with outdoor shooting, we will have to charge a $75 second-visit fee plus mileage.
Property Not Ready
If we arrive at a shoot and the property is not ready to shoot, Realiant Photography may charge up to the total amount of the shoot.
On-Site Safety
If our photographer arrives and determines that it is unsafe to shoot the property, they are not allowed to shoot it due to company policy. These reasons can include:
Uncontained animals
Structural issues
Biological hazards
Illegal drug paraphernalia
Angry renters or homeowners
Firearms in the open
Anything else that is potentially physically or mentally dangerous to our photographers
If the shoot is cancelled because of safety concerns, Realiant Photography may charge up to the total amount of the shoot.
Uncontained Animals
ALL dogs, no matter what size, must be kenneled or stored in a room/garage that the photographer will not access. Photographers will not be allowed to enter homes with loose dogs. Everyone thinks their dogs won't bite until one day they do. (Also, loose dogs can knock over costly cameras.)
If a loose animal damages our equipment, the person who books the shoot is responsible for fixing or replacing the equipment.
Rental Properties
The Realtor or homeowner must be present at tenant-occupied rental properties.
Help on Site
If the property is not quite ready and you need help moving some final things, the photographer, at their discretion, may or may not be able to help. However, if they do help, we will charge $75 per hour.
Ready to Shoot
Please get the property completely ready to shoot. The photographer is not responsible for moving, staging, cleaning, etc. While we do try to do minor things like putting toilet seats down, in the end, we are not responsible for staging or readiness. Typical items we see are:
Toilet seats up
Soap dispensers, scrubbies, and towels on counters in bathrooms and kitchens
Messy beds
Personal items in bedrooms/bathrooms
Kleenex boxes
Toothbrushes on counters
Dirty towels hanging
Dirty counters
Dirty floors
Changing lightbulbs
The idea is to make other people imagine this could be their house. When you leave personal items, it can take away from that illusion.
Realiant Photography may adjust window coverings, move small items, or turn on/off lights as necessary.
Turnaround Time
Photos should be ready by the next day at 3:30 pm but are usually completed sooner.
Same-day service for photos is available at an additional cost. Photos must be shot before noon. We will usually deliver images before 8:00 pm. If the images are not ready by 11:00 pm, then we will refund the same-day additional fee and $25.
Video is usually delivered the next day, although in some cases it can be two days out.
3D tours are usually delivered the next day but sometimes take two days.
Copyright and Licensing (Photo/Video Rights)
Copyright and Ownership: Realiant Photography ("Photographer") is and remains the sole copyright owner of all photographs, videos, and related media ("Media"). No ownership rights are transferred under this Agreement. All rights not expressly granted are reserved by Photographer.
Definitions: "Client" means the individual listing agent who orders and pays for the Media. "Brokerage" means the Client's real estate brokerage and/or any parent entity, franchise, brand, or affiliated agency (for example, "RE/MAX," "Keller Williams," or similar). "Listing Term" means the period during which Client is the listing agent of record and the property is actively marketed for sale (or lease, if applicable) under Client's listing.
License Granted to Client (Listing Agent) - Perpetual Agent License: Upon full payment, Photographer grants Client a perpetual, worldwide, non-exclusive, royalty-free, non-transferable license to use the Media for the following purposes:
A) Property Marketing During Listing Term: Client may use the Media to market and advertise the specific property for sale (or lease) during the Listing Term, including use on MLS, brokerage listing pages, real estate portals via MLS syndication, print collateral, email campaigns, social media, video platforms, and any other customary real estate marketing channels.
B) Client Self-Promotion and Portfolio Use (In Perpetuity): Client may use the Media indefinitely for Client's own professional marketing, portfolio, and self-promotional purposes, including (without limitation) Client's website, social media, presentations, proposals, listing presentations, printed marketing materials, advertising, and other marketing channels, even after the Listing Term ends.
Important Limitation: After the Listing Term ends (including once the property is sold/closed, withdrawn, expired, or Client is no longer the listing agent of record), Client may continue using the Media only for Client's self-promotion/portfolio purposes and may not use the Media to market the property as currently for sale (or lease) or in any way that would reasonably imply the property is an active listing.
No License Granted to Brokerage/Parent Agency Except Limited Listing Use: Except as expressly provided below, no rights are granted to Brokerage. Photographer does not grant Brokerage any perpetual or general marketing license.
Limited Brokerage License (Listing-Only): Upon full payment, Photographer grants Brokerage a limited, non-exclusive, non-transferable license to use the Media solely to market the specific property for sale (or lease) during the Listing Term, and only in the following ways:
MLS submission and MLS-related syndication
Brokerage-controlled listing pages or property-specific marketing pages for the active listing
Brokerage marketing materials directly tied to selling the property during the Listing Term
Brokerage Termination of Rights: Brokerage's right to use the Media automatically terminates when the Listing Term ends (including once the property is sold/closed, withdrawn, expired, or Client is no longer the listing agent of record). After termination, Brokerage must stop using the Media and remove it from Brokerage-controlled websites and marketing materials within a reasonable time (and in any case as promptly as feasible), except where removal is not within Brokerage's direct control due to third-party syndication.
Restrictions Applicable to All Parties:
No resale, relicensing, or transfer: Client and Brokerage may not sell, sublicense, assign, gift, or otherwise transfer the Media to any third party (including another agent who later takes the listing), except as necessary to place the Media on MLS or to engage vendors strictly performing services on Client's behalf (e.g., print vendors, web hosts) for the permitted uses above.
No use for unrelated commercial purposes: The Media may not be used to market third-party products/services or for purposes unrelated to real estate marketing for the property during the Listing Term or Client's self-promotion/portfolio use thereafter, unless Photographer grants written permission and any applicable licensing fees are paid.
Nonpayment / Infringement: Payment in full is required before Media may be downloaded and used. Any use of Media without full payment constitutes copyright infringement. Client and/or Brokerage will be required to remove the Media from all platforms and materials and may be subject to legal action through arbitration as described in Section 23.
Media Rights and Usage for Builders, Stagers, Designers, Homeowners, and Others
Builders, stagers, designers, homeowners, and others who wish to use Media taken by our photographers should contact us for specific licensing information. In addition to any fees paid to Realiant Photography, a property photography release may need to be obtained from the homeowner.
Marketing
Both Realiant Photography and the Client are allowed to use the Media for their marketing purposes, subject to the licensing terms in Section 9.
By ordering a product, the Client opts in to Realiant Photography's mailing list. The Client can opt out at any time.
Scheduling
Please use our online booking system at RealiantPhotography.com.
Payment
Payment in full is expected before Media can be downloaded and used. A watermarked preview will be available via Realiant Photography's website for Client approval.
Credit cards are preferred, but checks are acceptable.

Unethical Retouch
The photographer will not retouch Media to disguise known defects and/or physical structures such as wall/floor blemishes, driveway cracks, power lines, power boxes, etc.
Backup
Final Media are backed up by Realiant Photography and are available to be re-delivered for up to 90 days from the delivery date. Media may no longer be available beyond that period. We recommend that the Client make a local backup of the Media for their permitted uses.
Late Fees
Payment is due at the time of delivery. Fees not paid are subject to a 2% interest fee per month and a late fee of $35 after the first month of delinquency.
Final Satisfaction
Shooting real estate is much more of an art than a science. While we have well-trained photographers, sometimes the Media we deliver is not what you or the homeowner have in mind. Sometimes this is our fault, and other times it is simply different expectations.
We are not responsible if you are unhappy with the artistic composition of the Media. For example, if the Realtor or homeowner thought a picture should have been from a different angle. If you have exact requirements, we welcome you to join us at the shoot and direct where you would like the shots from. Otherwise, we will use our best judgment shooting a wide variety of homes over the years.
We typically shoot the following photos:
2-4 of the kitchen
2-4 of the living room
1-3 of the dining room
2-3 of the primary bedroom
1-2 of each bathroom
1 walk-in closet
1-2 regular bedrooms
1 of the entryway
1-2 for each additional room
4-8 exterior photos
If we miss a major room (kitchen, living room, primary bedroom, dining room), we will come back to reshoot at no cost to you.
If we miss any other rooms, we may come back at our cost or ask you to take a picture with the wide-angle lens on your cell phone (we will give you instructions). We will then edit this to look like our photos. For each of these, we will offer a $10 discount.
We find that sometimes homeowners who are very attached to their homes tend to have particular things they would like to see that are impossible for us to know in advance, especially if they built the home. If you, as a Realtor, sense that your client might be high maintenance, please get a list of shots from them. They are also welcome to be on-site to confirm the shots with us as we shoot them. We want them to be happy, so they will refer you to others.
Custom Editing
If there are items in the shot that you want to be removed, we can usually "Photoshop" them out. If they exist because of something we did (for example, leaving a water bottle on a table), we will do that at no cost. Anything else will be charged at the rate of $75 per hour and will be done only if you request it.
Errors and Omissions
If we create a rough outline of a lot's boundary on the imagery, we are not responsible for errors in the property boundary. If you need an accurate property boundary, you need to hire a licensed surveyor.
Indemnification
Client will indemnify and defend Photographer against all claims, liability, damages, costs, and expenses, including reasonable attorneys' fees and expenses, arising out of the creation or any use of the Media or materials furnished by Client. It is the Client's responsibility to obtain the necessary model or property releases and ensure they are in full effect and force.
Delivery
Photographer may select delivery of photographs in JPEG at a resolution determined to be suitable for the Media as licensed. It is the Client's responsibility to verify that the Media are suitable for reproduction and, if the Media are not deemed suitable, to notify the Photographer within 7 business days.
No Exclusivity
This Agreement does not create an exclusive relationship between the parties. Client is free to engage others to perform services of the same or similar nature to those provided by Photographer, and Photographer is free to provide services to others and advertise the services offered by Photographer.
Mandatory Arbitration (All Legal Disputes)
Governing Law: This Agreement is governed by Oregon law.
Arbitration Required: Any dispute, claim, or disagreement arising out of or relating to this Agreement, the services, the Media, or billing must be resolved by binding arbitration. The parties agree not to file a lawsuit in court to resolve disputes covered by this section. The arbitrator's decision will be final and may be enforced like a court judgment.
How Arbitration Will Work:
The arbitration will be held in Benton County, Oregon, unless the parties agree to do it remotely (video/phone) or at another location.
The arbitration will be conducted by a neutral arbitrator under rules chosen by the parties. If the parties cannot agree on rules/provider, the arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules.
Each party will pay its own attorney fees and costs, unless the arbitrator awards fees under applicable law.
Severability
If one or more provisions of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect. Any invalid provision shall be revised only to the extent necessary to make it enforceable.
Waiver
No action of either party, other than an express written waiver, may be construed as a waiver of any provision of this Agreement. A single or partial exercise of any right or remedy does not prevent further exercise of that or any other right or remedy.
Termination
By Either Party for Breach of Agreement: Either party may terminate this Agreement if the other party materially breaches any obligation, representation, or warranty herein, by giving the breaching party 15 days' written notice and the right to cure such breach.
